Introduction

This document outlines the terms and conditions (“T&Cs”) governing your use of any Imaliwise Web Services digital resource, platform, or website (collectively referred to as “platforms” or “website”). Imaliwise Web Services operates independently and is a sister company to Imaliwise.co.za.

These T&Cs cover your rights and responsibilities, including matters relating to usage, privacy, data, intellectual property, and your legal rights in terms of the Protection of Personal Information Act (POPIA).

Section A: Acceptance & Definitions

1. Use of any Imaliwise Web Services resource is subject to your full acceptance of these T&Cs.
2. Continued use of our platforms implies your legal agreement to these terms, and you will be deemed a “User.”
3. If you wish to terminate this agreement, please notify us in writing at: support@imaliwisewebservices.co.za. Termination of this agreement ends your right to engage with our platforms, though you remain bound by these terms for the duration of use.
4. “Platforms” refers to any digital property owned or managed by Imaliwise Web Services, including websites, portals, and communication tools.
5. “Content” includes but is not limited to text, images, video, downloads, contact forms, and any other data.
6. “Process” in relation to data includes collection, storage, dissemination, analysis, and any other use of personal or business information.

Imaliwise Web Services (Pty) Ltd is a South African-based, client-focused digital services provider. Services include:

• Web design and development
• SEO services
• Management of business directories and trade directory platforms

We promote, build, maintain, and facilitate online platforms for businesses and professionals.

We reserve the right to amend these T&Cs at any time. Continued use of our platforms constitutes agreement to the current version.

Users with concerns must contact us in writing and allow five working days for internal resolution before seeking external remedies.

Section C: Personal Information & Privacy

By interacting with our platforms or services, you consent to us processing your personal or business information for the following purposes:

• Transaction processing
• Directory or listing management
• Marketing and newsletters
• Analytics and service improvement

We collect data via forms, emails, digital tools, social media, and communication platforms. Casual browsing does not result in the processing of identifiable personal data.

We do not sell personal information and only share necessary data with authorized staff, agents, or suppliers directly involved in service delivery. Data is retained and processed in accordance with POPIA.

False or fraudulent submissions may result in legal action.

Where content is sourced externally or via public domain, we acknowledge the rights of the originators. If you believe your rights have been infringed, please notify us via email.

We reserve the right to change or update content and services without notice.

Section E: Usage Levels

1. Passive Use (Browsing)
You may browse our website without submitting personal data. However, standard analytics such as IP addresses may be recorded.

2. Unsolicited Content
If you submit unsolicited content to our platforms, you grant us a non-exclusive, royalty-free right to use and distribute such content.

3. Active Engagement (Client Use)
If you request services, quotes, or enter a business relationship with us, you consent to the processing of your information for contractual and operational purposes, including sharing data with service providers or directory listings where applicable.

We only request information necessary to fulfill services, and refusal to provide such data may affect service availability.

Business Transfers
Should Imaliwise Web Services be sold or restructured, we will notify Users in advance before transferring data.

Prohibited Technologies

Online Payments
Payments made via third-party gateways are at your own risk. We do not store card details and disclaim liability for payment gateway breaches.

Jurisdiction & Law
These terms are governed by the laws of South Africa. Any disputes will fall under the jurisdiction of the Western Cape High Court.

Limitation of Liability
Our platforms are provided “as is”. We make no guarantees regarding accuracy, availability, or functionality and are not liable for any damages resulting from use.

You agree to indemnify us against any claims arising from your use of our services or breach of these T&Cs.
